Slab Restoration Rule Book
This Slab Restoration Rule Book sets forth the specific provisions governing all slab restoration services offered by Memorabilia Germany.
It sets forth the specific terms and conditions for the performance of slab restoration orders and supplements Memorabilia Germany’s General Terms and Conditions as well as its other legal documents.
This Rule Book applies in particular to the following services:
- Trading Card Slab Restoration
- Comic Slab Restoration
- as well as all slab restoration services offered by Memorabilia Germany in the future.
By engaging a slab restoration service, the client acknowledges that the version of this Slab Restoration Rule Book published at the time the order is placed serves as the binding basis for the performance of the order.
This Slab Restoration Rule Book supplements the General Terms and Conditions as well as the other legal documents of Memorabilia Germany.
1.1 Scope of the Slab Restoration Service
The purpose of the Slab Restoration Service is to professionally perform the booked, multi-step restoration process on the outer surface of the slab that was sent in.
As part of our multi-step restoration process, the surface of the slab is professionally treated to achieve the greatest possible visual improvement. However, we cannot guarantee the complete removal of all scratches.
1.2 Performance Principles
The following principles apply to all slab restoration services:
- The slab is not opened at any point during the restoration process.
- A specific final optical result is not guaranteed.
- The success of slab restoration depends in particular on the type, depth, location, and extent of the existing damage, as well as on the material and construction of the slab in question.
- Slab restoration can reduce scratches and signs of wear, but some marks may remain visible.
1.3 Eligible Grading Companies
The Slab Restoration Service is generally available for slabs from all grading companies.
These include, in particular, PSA, CGC, Beckett, SGC, CBCS, and other comparable grading companies.
2.1 Placing an Order
The provisions of Memorabilia Germany’s General Terms and Conditions apply to the formation of the contract for the respective Slab Restoration Service.
Slab restoration is performed based on the services booked when the order was placed and the information provided by the client.
The service description for the specific Slab Restoration Service booked, as published at the time the order was placed, shall be binding.
The scope of services itself continues to be defined by the text already approved for professional editing and the feasible options.
2.2 Required Information from the Client
The personal information provided by the customer that is required to place an order is collected as part of the standard ordering process on the Memorabilia Germany online store.
The Slab Restoration Rule Book does not contain any additional provisions on this matter.
The client warrants that he or she is authorized to submit the collectibles and to commission Slab Restoration to restore them. Proof of ownership is not required for this purpose.
Memorabilia Germany is not obligated to verify the client’s ownership status or other rights.
The client shall indemnify Memorabilia Germany against any claims by third parties arising from the submission of collectibles for slab restoration without the appropriate authorization.
2.3 Required Information for Each Collectible
For each collectible submitted for slab restoration, the following information must be provided in full:
- Grading Company
- Name of the Trading Card or comic book
- Certification Number
- Fair Market Value (Insurance Value)
This information is intended, in particular, to
- the unambiguous identification of the collectibles submitted,
- the documentation,
- as well as determining the necessary insurance coverage.
2.4 Fair Market Value
The client is required to provide a realistic fair market value for each collectible submitted.
The values provided are intended, in particular, to
- determining the necessary insurance coverage,
- the calculation of any high-value surcharges,
- as well as a possible settlement of the claim.
Memorabilia Germany generally accepts the fair market values provided by the client as the basis for further processing.
There is no general valuation or regular review of the stated fair market values.
Obvious discrepancies
If Memorabilia Germany identifies any apparent and significant discrepancies between the stated fair market value and the market value it expects based on its own assessment, Memorabilia Germany is entitled to,
- Please direct any questions to the client,
- request appropriate proof of value, or
- to adjust the fair market value in consultation with the client.
Consequences of Incorrect Value Declarations
If fair market values are reported too low, collectibles that are sent in may not be insured for a sufficient amount.
The client is responsible for the accuracy of the fair market values it provides.
To the extent that underinsurance is due to inaccurate value information provided by the client, Memorabilia Germany shall not be liable for any resulting disadvantages or damages not covered by the insurance policy.
2.5 Combination with CGC Submission
CGC Submission and Slab Restoration are generally separate services. Shipping costs, high-value surcharges, and return shipping are therefore generally billed and handled separately.
Typically, the slab restoration items are shipped back separately immediately after processing is complete.
“Combined Return” Option
If both CGC Submission items and Slab Restoration items from the same collectible category are in the shopping cart at the same time, the customer can select a combined return shipping option during the checkout process.
By selecting this option, the client expressly agrees to
- that all affected collectibles be returned together,
- that slab restoration items that have already been completed will remain with Memorabilia Germany until the CGC submission is finalized,
- and that the return shipment of the slab restoration items will be delayed accordingly.
Impact
If a combined return shipping option is selected,
- Shipping costs for Slab Restoration are waived,
- only a single combined return shipment will be made,
- and the high-value surcharges are calculated based on the combined fair market value of the collectibles to be returned together.
Restriction
Combined returns are only possible within the same Collectible category.
The following are permitted:
- Trading Card Submission and Trading Card Slab Restoration
- Comic Submission and Comic Slab Restoration
The following are not permitted:
- Trading Card Submission and Comic Slab Restoration
- Comic Book Submission and Trading Card Slab Restoration
In such cases, the respective services are billed and returned separately.
2.6 Processing and Turnaround Times
All processing and turnaround times listed are non-binding estimates based on experience.
The actual processing time depends in particular on internal processing procedures, workload, the nature and scope of the order, and any necessary follow-up inquiries.
Delays beyond Memorabilia Germany’s control generally do not give rise to any claims against Memorabilia Germany.
Whenever possible, Memorabilia Germany will notify the client of significant delays as soon as they become known.
3.1 Eligibility Requirements
A prerequisite for performing the Slab Restoration Service is that the material, construction, and condition of the slab in question allow for professional treatment as part of the slab restoration process.
Memorabilia Germany reserves the right to refuse to process individual slabs if proper processing is not possible or does not appear feasible due to the materials used, the slab’s construction, or its condition.
3.2 Exclusion Criteria for Slab Restoration
Not every slab is suitable for a professional slab restoration. Memorabilia Germany therefore reserves the right to exclude individual slabs from processing if their condition or nature prevents the restoration process from being carried out properly.
In particular, the following slabs may be excluded from processing:
- Slabs with fractures or cracks.
- Slabs that are severely warped or damaged by heat.
- Slabs with chemical damage or material changes.
- Slabs that have already been improperly processed or repolished, provided that this makes a professional restoration no longer possible or practical.
- Slabs with significant contamination.
- Slabs with mold or other biological contaminants.
- Other slabs whose condition does not permit the proper performance of the Slab Restoration Service, or for which there is a processing risk that Memorabilia Germany deems unacceptable.
3.3 Packaging the Submission
The client must package the slabs securely for transport and provide adequate protection against damage during shipping.
The packaging must be selected so that the condition of the slabs remains unchanged during transport to Memorabilia Germany.
Inappropriate packaging
Items that are obviously inadequately packaged or grossly unsuitable for shipping may be excluded from processing by Memorabilia Germany.
3.4 Risk of Loss During Outbound Shipping
The client bears the shipping risk until the slabs sent to Memorabilia Germany are verifiably received.
Documented acceptance of the shipment by Memorabilia Germany serves as proof of receipt of the goods.
3.5 Resubmissions
If, after completion of a slab restoration order, an item is resubmitted to Memorabilia Germany, the responsibilities and the allocation of any resulting shipping and processing costs will depend on the reason for the resubmission.
If the cause falls within Memorabilia Germany’s area of responsibility and Memorabilia Germany acknowledges the underlying, objectively verifiable facts, Memorabilia Germany will handle the organization of the subsequent proceedings.
If the resubmission is made at the client’s request or as part of a newly commissioned service, the client shall bear the resulting costs.
4.1 Receipt of Goods and Safety Documentation
Upon receipt of the shipment, Memorabilia Germany will inspect the submission for completeness, obvious shipping damage, and any apparent grounds for exclusion as specified in this Slab Restoration Rule Book.
Safety Documentation
The receipt of goods and the condition of the slabs received are documented through photographs and/or video recordings as part of safety documentation relevant to insurance and quality assurance.
This documentation is intended, in particular, to
- the traceability of the original condition of the slabs received,
- the settlement of claims against transportation service providers or insurers,
- as well as documenting the initial condition before the slab restoration process begins.
Any pre-existing surface damage, material irregularities, or other characteristics relevant to the subsequent processing or a future complaint may be recorded separately in this documentation, to the extent that Memorabilia Germany deems it necessary.
4.2 Submission Deadline After Order Placement
Once the order has been successfully placed, the slabs intended for slab restoration must be shipped to Memorabilia Germany within fourteen (14) calendar days.
Reminder and Grace Period
If no shipment is received within this period, Memorabilia Germany will send the client an email reminder regarding the outstanding shipment of the slabs and grant a one-time extension of seven (7) calendar days.
Failure to Submit
If the goods are not received by the end of this grace period, Memorabilia Germany is entitled to cancel the slab restoration order.
In this case, the work performed up to that point remains subject to payment.
Memorabilia Germany charges a processing fee of 30% of the restoration price for the requested services.
This applies accordingly if the client expressly requests cancellation of the slab restoration order before the goods are received.
Any payments already made in excess of this amount will be refunded accordingly.
4.3 Rejection of Individual or All Slabs Upon Receipt of Goods
If, upon receipt of the shipment, Memorabilia Germany determines that some or all of the submitted slabs do not meet the requirements for slab restoration, the client will be notified of this, along with the reason for the rejection.
The following rules apply to rejected slabs:
- The affected slabs will not be processed.
- Any restoration fees already paid for these slabs will be refunded.
- Shipping costs and high-value surcharges that have already been charged will not be refunded on a pro-rata basis.
- Rejected slabs are returned to the client along with the remaining collectibles.
If all submitted slabs are excluded from processing, the shipping costs that have already been charged will be used to cover the return shipping of the slabs. Shipping costs will not be refunded.
Submissions that are grossly improper
If the rejection is based on a grossly improper submission —particularly in cases of mold growth, significant soiling, or comparable unacceptable circumstances—Memorabilia Germany is entitled to withhold a processing fee equal to 30% of the respective restoration price of the affected slabs.
4.4 Changes to the Order After It Has Been Placed
If the contents of a submission differ from the originally commissioned slab restoration job, further processing will be carried out in accordance with the following principles.
Fewer slabs than ordered
If fewer slabs are submitted than ordered, slab restoration will be limited to the slabs that were actually submitted.
No refunds will be issued for slabs that are not submitted.
More slabs than ordered
If more slabs are submitted than were ordered, Memorabilia Germany will notify the client of the discrepancy.
The additional slabs submitted will be processed only after the order has been adjusted accordingly and any necessary additional charges have been calculated. If this results in additional charges, the provisions of Sections 4.5 and 4.6 of this Rule Book shall apply.
Incorrect Restoration Service
If items are submitted that do not correspond to the Restoration Service that was booked (e.g., Trading Cards instead of comics, or comics instead of Trading Cards), Memorabilia Germany will notify the client of the discrepancy.
To the extent possible, adjustments will be made to reflect the applicable Restoration Service. Any resulting additional or reduced costs will be taken into account accordingly.
If a clear assignment is not possible, further processing will not take place until after consultation with the client.
Order Change Fee
If a change to the order caused by the client requires additional communication with the client, Memorabilia Germany is entitled to charge a flat fee of €6.99 for the order change.
The flat fee is intended to offset the additional administrative burden resulting from this.
4.5 Additional Claims
If any additional fees or other costs arise in connection with a slab restoration job that can be clearly attributed to that specific job, they will be billed to the client.
The client is required to pay any such additional charges within fourteen (14) calendar days of the invoice date.
Until payment has been received in full, Memorabilia Germany is entitled to withhold the return of the slabs in question.
4.6 Failure to Pay After Services Have Been Rendered
If any outstanding additional charges are not paid within the specified payment period, Memorabilia Germany will initiate the prescribed collection procedure in accordance with statutory provisions and internal procedures.
The reminder cycle is generally fourteen (14) calendar days.
The third reminder also serves as the final demand for payment. It already includes a notice stating that, if the specified deadline passes without a response, measures permitted under German law may be taken to enforce the claim.
Provided that the legal requirements are met, Memorabilia Germany is entitled to dispose of the retained slabs to the extent permitted by law.
From legally permissible proceeds from the sale of assets, the following in particular are
- outstanding receivables,
- Disposal costs,
- Storage costs,
- as well as reasonable collection and administrative costs
paid.
Any surplus remaining after all valid claims and costs have been settled shall be paid to the client and handled in accordance with legal requirements.
4.7 Failure of the Client to Cooperate
If carrying out a slab restoration order requires consultation with the client, Memorabilia Germany will notify the client via email regarding the matter in question.
Response Deadline
The client is given a response period of fourteen (14) calendar days.
If no response is received within this period, Memorabilia Germany will send the client a single reminder via email and grant an additional response period of seven (7) calendar days.
No Response
If no response is received even within the grace period, Memorabilia Germany is entitled to,
- to continue the order with regard to the slabs that have been clearly specified and are ready for processing,
- To leave slabs unprocessed if their processing requires feedback or approval from the client,
- and to return all submitted slabs to the client.
No fees will be refunded for services that cannot be performed due to the client’s failure to cooperate.
4.8 Changes After Goods Receipt
Once Memorabilia Germany has documented receipt of the goods, ordered slabs can no longer be removed from a slab restoration order.
Elimination of the need to process individual slabs
Until work begins, the client may request that certain slabs not be processed.
In this case, no processing is performed on the affected slabs.
There will be no refund of the restoration fees charged for this.
4.9 Termination of a Slab Restoration That Has Already Begun
If, during the slab restoration process, Memorabilia Germany determines that further work is not technically advisable or justifiable due to previously unrecognized material properties, damage, or other circumstances, the restoration process that has already begun may be terminated at any time.
Procedure
In this case
- the client will be informed of the termination and the reason for it,
- the slab in question is not processed further,
- The slab in question will be returned to the client along with the other collectibles.
Fees
Since the slab restoration process has already begun, the full restoration cost for the affected slab remains due.
The restoration fee charged for this service is non-refundable.
4.10 Multiple Orders in a Single Submission
If multiple slab restoration orders or different service orders are sent together in a single shipment to Memorabilia Germany, the individual orders remain separate from one another for organizational and billing purposes.
A joint submission does not entitle the submitter to joint processing, consolidation, or a different calculation.
The only exceptions to this rule are the possible combinations explicitly specified in the Rule Book.
5.1 Returns
Once slab restoration is complete, the processed slabs will be returned to the shipping address provided by the client.
Return shipments are always insured. To this end, Memorabilia Germany uses shipping insurance that is specifically tailored to the transport of high-value collectibles.
The specific insurance coverage is based on the fair market value specified by the client, the agreed-upon maximum coverage limits, and the terms of the respective insurance contract.
Unless a combined return shipment with a CGC submission was agreed upon when the order was placed, the return shipment will be made immediately after the slab restoration is completed.
5.2 Claims Settlement for Returned Shipments
If loss, damage, or a shortage occurs during a shipment organized by Memorabilia Germany, Memorabilia Germany will handle all communication and claims processing with the involved shipping providers and the insurer.
The Client agrees to assist Memorabilia Germany to the extent necessary in determining the extent of the damage and processing the insurance claim, and to provide, upon request, appropriate documentation, in particular proof of value or proof of purchase.
Any compensation will be determined based on the terms of the respective insurance coverage, the applicable insured values, and the results of the respective claims investigation.
The fair market value specified by the client does not automatically entitle the client to compensation in that amount.
Memorabilia Germany has no further liability for damages regardless of fault. The statutory liability provisions and the General Terms and Conditions remain unaffected.
5.3 Refusal to Accept or Undeliverable Returns
If a return shipment sent by Memorabilia Germany cannot be delivered for reasons attributable to the client, in particular due to a refusal to accept the package, failure to pick it up on time, or incorrect or incomplete address information, and the shipment is returned to Memorabilia Germany, the client will be notified accordingly.
Reshipment
A new shipment will be sent only after payment has been received
- the shipping costs incurred again,
- any costs incurred by the shipping provider as a result of the return,
- as well as an administrative fee of €9.99.
We do not refund the shipping costs originally charged.
6.1 Complaints Procedure
Any complaints regarding a slab restoration order must be reported by the client to Memorabilia Germany in writing.
Complaint Period
Obvious complaints, in particular damage incurred during shipping, shortages, or other apparent discrepancies, must be reported in writing no later than seven (7) calendar days after delivery.
A late or incomplete damage report may hinder the enforcement of claims against transportation service providers or insurers.
The client is responsible for any resulting disadvantages to the extent that they are due to a breach of the client’s obligations to cooperate.
Obligations to Cooperate
The client is obligated to,
- to retain the original packaging, including all packaging materials, until the complaint review is complete,
- to provide appropriate photos, videos, or other supporting documentation upon request,
- and to assist Memorabilia Germany to the extent necessary in reviewing the complaint.
6.2 Review of Complaints
Memorabilia Germany reviews each claim based on the available documentation and the information provided by the client.
In particular, the following can be used for this purpose:
- the safety documentation for incoming goods,
- Documentation of the processing procedure,
- Photos and videos,
- as well as other objective evidence
be used.
6.3 Scope of the Audit
When handling a complaint, Memorabilia Germany considers only facts that can be objectively verified.
These include:
- Damage during shipping,
- Shortages,
- Confusions,
- Damage,
- as well as any other objectively verifiable deviations from the slab restoration order.
Basis for the Audit
The review is conducted based on the available documentation and the supporting evidence provided by the client.
Memorabilia Germany will decide how to proceed based on the results of the complaint review.
7.1 Liability During Processing
From the time of documented receipt of the goods until they are returned, the slab remains in the custody of Memorabilia Germany.
During this period, Memorabilia Germany is liable, in accordance with statutory provisions, for damages arising within Memorabilia Germany’s sphere of responsibility.
Basis for a Claims Settlement
The basis for any claim settlement is the fair market value specified by the client when placing the order.
If, in the event of a claim, the stated fair market value proves to be too low and this results in underinsurance, the client bears the resulting risk.
7.2 Force Majeure
If Memorabilia Germany is temporarily unable to provide the Slab Restoration Service, or can do so only to a limited extent, due to events of force majeure or other circumstances beyond its control, processing and delivery times will be extended by the duration of the disruption.
These include, in particular, natural disasters, fires, floods, government actions, pandemics, strikes, power outages, significant disruptions to transportation or logistics services, and other unforeseeable events beyond Memorabilia Germany’s control.
Memorabilia Germany will inform the client of such circumstances to the extent that this is reasonable and feasible.
8.1 Changes to the Slab Restoration Rule Book
Memorabilia Germany reserves the right to amend this Slab Restoration Rule Book in the future, to the extent that this becomes necessary for legal, technical, or organizational reasons.
For each Slab Restoration order, only the version of the Slab Restoration Rule Book published at the time the order is placed shall apply.
8.2 Governing Language
The Slab Restoration Rule Book will be published in German.
If translations into other languages are provided, they are intended solely to aid in understanding.
In the event of any discrepancies or contradictions, the German version shall be the sole authoritative version.
